Waiting Room Theater - Terms & Conditions

Acceptance

Thank you for agreeing to become a subscriber to Waiting Room Theater (“WRT”).  By becoming a subscriber, you accept, without limitation or qualification, the Terms and Conditions contained below and all applicable laws. We may at any time revise these Terms and Conditions by updating this posting. You agree to be bound by such revisions, and you should periodically revisit this page to review the then current Terms and Conditions.


Duration of the Agreement

You agree to subscribe to WRT for the duration of 36 months from the date of your acceptance of this Agreement.   This Agreement will automatically renew at the end of the term, unless written notice is provided at least 30 days prior to the termination of the Agreement that you do not wish to renew the Agreement.

Payment:

You agree to pay WRT or its financing agent the sum determined in your WRT Subscription Agreement during the term of the Agreement.  Should you fail to timely pay during the term of the Agreement, WRT may declare the Agreement to be in default, and immediately accelerate the amount of payment such that the remaining balance will be immediately due and owing.


Warranties and Disclaimers:

You agree that the information received by WRT is provided "as is" without warranty of any kind, either express or implied, including without limitation, as to the accuracy of or non-infringement of property rights in the content, whether or not WRT has been given notice of any such defect.

WRT, its directors, officers, employees and suppliers are not liable in contract or otherwise for any direct, indirect, or consequential loss or damage of whatever nature sustained by a YOU or others directly or indirectly as a result of making use of the information provided by WRT, and the data in it.

In agreeing to subscribe to WRT, You expressly waive any and all claims that You may have against WRT, its directors, officers, employees and suppliers arising out of such use, and agree to indemnify WRT and such persons and entities against all actions, proceedings, costs, claims, demands, liabilities and expenses whatsoever incurred by WRT as a result of a breach of these Terms and Conditions by a User.


Copyright and Trademarks

You should assume that everything you see or read on the information provided by WRT is copyrighted unless otherwise noted.

The copyrights are the property of WRT and its licensors unless otherwise stated. The reproduction or use of part or all of the content in any way (including without limitation viewing, downloading, printing and saving) is prohibited except in accordance with the following conditions:

You may download material for internal corporate or for personal use only provided you also retain all copyright and other proprietary notices contained in the materials. You may not distribute, broadcast, modify, transmit, reuse, re-post, or use in any form the content, or use the content to build other databases without our written permission.

Any images of people used on this site are used with permission or in accordance with applicable law. Reuse of them without permission may violate privacy and publication rights of those persons.

The trademarks, logos, and service marks (collectively the "trademarks") are registered and unregistered trademarks of WRT and others. Your use of the trademarks displayed on the Site is strictly prohibited without written permission.

WRT reserves the right to revoke these permissions at any time without reasonable notice.


Required Equipment

During the term of this Agreement, You agree that you will do all of the following:

A) Maintain public Internet access from your dental offices or from the dental office via the Waiting Room Theater data center

B) Provide an available network port with previously noted access at your dental office

C) Be responsible for maintenance of all data networks, switches, hubs, routers, firewalls, power, and other such required infrastructure not provided by WRT and/or its designated agent(s) to support media distribution

D) Agree to allow the passage of data via mutually agreed upon network ports, and at mutually agreed upon times of day

E) Provide WRT and/or its designated agent(s) with contacts (and an escalation process) for reporting network outages, latency, and related items

Termination

WRT may terminate a subscriber immediately without notice in the event of a breach of these Terms and Conditions.


Applicable Law

You agree that the laws of the California apply to any issue that may arise with WRT.
